DSA Dispute Resolution Process
At the Data Science Association (DSA), we are committed to fostering a fair and efficient environment for all our members, partners, vendors and others. Should a dispute arise, we encourage an amicable resolution process as outlined in Article 11 of our Terms & Conditions. Our Alternative Dispute Resolution (ADR) process is designed to resolve issues efficiently and confidentially, minimizing the need for formal litigation.
Our Three-Step Alternative Dispute Resolution Process:
Our dispute resolution process follows a clear, multi-stage approach to help parties reach a mutually agreeable solution:
- Negotiation (Up to 100 Days): The initial step involves direct, good-faith negotiation between the involved parties' authorized representatives. We believe many issues can be resolved through open communication and understanding. If a resolution is not reached within 100 days of a written dispute notice, the process moves to mediation.
- Mediation: If negotiation is unsuccessful, the dispute will proceed to confidential mediation. A neutral mediator, either mutually agreed upon by the parties or selected by JAMS (a leading alternative dispute resolution services provider), will facilitate discussions. The mediator's role is to help the parties find common ground; they do not have the authority to make binding decisions.
- Arbitration: Should mediation not lead to a resolution, the dispute will then be submitted to binding arbitration. This arbitration will be conducted in accordance with JAMS rules and will take place in the State of Delaware, United States. With the agreement of all parties, arbitration may also be conducted online via Zoom or another internet platform. A neutral arbitrator, chosen by the parties or by JAMS, will apply the laws of the State of Delaware, and their decision will be final and binding.
Important Note: By engaging in this dispute resolution process, all parties waive their right to a jury trial for any disputes arising from our Terms & Conditions. The State of Delaware, United States, governs these Terms and any disputes not resolved through ADR will be exclusively handled in Delaware courts.
